These terms govern your use of www.joecena.com (the "Site"), a personal portfolio operated by Joe Cenatiempo ("I", "me", "my").
By visiting the Site you agree to these terms. If you do not agree with them, please do not use the Site.
Acceptance of these terms
By accessing, browsing, or otherwise using the Site, you accept these terms in full and agree to be bound by them, together with the Privacy Policy, which is incorporated here by reference.
If you are using the Site on behalf of an organization, you represent that you have authority to bind that organization to these terms.
What the Site is
The Site is a personal portfolio and professional biography. It exists to describe my background and to let prospective employers, clients, and collaborators reach me.
There is no account to create, nothing to buy, and no contact form. The only way to begin any business through the Site is to write to the address at the end of these terms.
Permission to use the Site
You may view the Site, and download or print single copies of its pages and of the resume it links, for your own personal or internal business use in evaluating me as a candidate, contractor, or collaborator. That permission is limited, revocable, non-exclusive, and non-transferable, and it grants you no other right.
You may not:
- Republish, sell, rent, sublicense, or otherwise commercially exploit any part of the Site.
- Copy the Site's design, layout, or source code to produce a substantially similar site or service.
- Use the Site's content to train, fine-tune, or ground an automated system without my written permission.
- Present my work, credentials, or biography as your own, or alter them in a way that misrepresents them.
- Access the Site by automated means at a volume or rate that degrades it for anyone else.
- Attempt to gain unauthorized access to the Site or to any system connected to it, or probe, scan, or test its security.
- Interfere with the Site's operation, introduce malicious code to it, or use it to transmit anything unlawful.
Intellectual property
The Site's text, photographs, layout, and source code are mine and are protected by copyright and other intellectual property laws. Nothing in these terms transfers any of those rights to you.
Company names, logos, and trademarks shown on the Site belong to their respective owners and appear to identify organizations I have worked with or for. That is a descriptive, nominative use. It is not a claim of ownership, and it does not imply that any of those owners endorse, sponsor, or are affiliated with the Site or with me.
Accuracy, and what the Site is not
The Site describes past work. Parts of it are deliberately left as they were written at an earlier date, so it may not reflect my current availability, engagements, or skills. The resume linked from the Site is the more current record, and where the two differ the resume governs.
Nothing on the Site is legal, financial, technical, employment, or other professional advice, and nothing on it should be relied on as such.
Nothing on the Site is an offer of employment, an offer to enter into a contract, or a commitment to provide services. A binding agreement arises only from a separate written agreement signed by both parties.
Links to other sites
The Site links to third-party sites, including professional profiles and the sites of organizations named in my work history. Those sites are not under my control. I do not endorse them and I am not responsible for their content, availability, or practices. Your use of them is governed by their own terms and privacy policies.
Availability and changes to the Site
The Site is provided on an as-available basis. I may change, suspend, or discontinue any part of it, and may restrict access to it, at any time and without notice. I am under no obligation to keep any particular page, file, or URL reachable.
Disclaimer of warranties
THE SITE AND ALL OF ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, I DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, I WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, ON ANY THEORY OF LIABILITY, AND EVEN IF I HAVE BEEN ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
MY TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED US DOLLARS (US$100).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so parts of this section may not apply to you.
Indemnification
You agree to indemnify and hold me harmless from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your use of the Site, your breach of these terms, or your violation of any law or of any third party's rights.
Privacy
The Privacy Policy explains what the Site does and does not collect. It forms part of these terms.
Governing law and venue
These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute arising out of or relating to these terms or the Site will be brought exclusively in the state or federal courts sitting in New York County, New York, and you consent to the personal jurisdiction of those courts.
Changes to these terms
I may revise these terms by posting the revised version on this page and updating the date at the top of it. Changes take effect when they are posted. Continuing to use the Site after that means you accept the revised terms.
General
- If any provision of these terms is held unenforceable, the rest stay in force and the unenforceable provision applies to the greatest extent the law allows.
- Not enforcing a provision on one occasion is not a waiver of it on another.
- These terms, together with the Privacy Policy, are the entire agreement between you and me about the Site and replace any earlier understanding about it.
- You may not assign these terms. I may assign them in connection with a transfer of the Site.
